Terms & Conditions
§ 1 General
The present "Terms & Conditions", hereinafter referred to as "T&C", regulate the rights and obligations in the relationship between schlumpf innovations gmbh and its customers. They apply to all business relationships between schlumpf innovations gmbh and its clients, in particular to the delivery of products and the provision of services, unless otherwise agreed in writing. The T&C are subject to change without notice.
The version valid at the time of delivery of the products shall apply. In the event of changes after receipt of the customer's order and before the delivery date, the customer shall be notified of the change and shall have the right to cancel his/her/their order within five days.
§ 2 Delivery
The goods will be shipped to the delivery address indicated by the buyer.
If partial deliveries are desired, these are permissible, but are considered independent deliveries. Dispatch will only take place when the full invoice amount has been credited to the relevant account. The choice of the shipping route and the shipping method is left to the seller, unless the buyer decides on this when placing his/her/their order. Any additional costs compared to the normal shipping method will be charged to the buyer in full. In the case of deliveries abroad, customs duties, taxes and fees may be incurred which are not included in the total price shown.
§ 3 Prices
The prices of the products and services of schlumpf innovations gmbh are net prices including 7.7% Swiss value added tax in Swiss francs (CHF), ex company headquarters in Trimmis. Incidental costs such as costs for packaging and shipping are not included in the prices, any delivery costs will be invoiced in a separate item. For deliveries abroad, customs duties, taxes and fees may be incurred which are not included in the total price shown.
We reserve the right to make changes to the design or in the technical area which do not change the function and quality of an article, as well as errors in description, pictures and price. The information in our sales documents is to be understood as indicative only and does not constitute a guarantee of characteristics, unless it is expressly stated in writing to be binding. schlumpf innovations gmbh can make changes to the price list as well as to the design or the technical area at any time without prior notice.
§ 4 Retention of Title
The delivered goods remain the property of schlumpf innovations gmbh until full payment has been received.
§ 5 Transfer of Benefit and Risk
The risk is transferred to the customer when the products are handed over to the carrier.
§ 6 Self-assembly
When purchasing a product from schlumpf innovations gmbh, which is designed for self-assembly by the customer, the supplied assembly instructions must be strictly observed and complied with. Any liability for improper assembly that deviates from the respective assembly instructions is expressly rejected.
§ 7 Warranty
Swiss law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The purchaser must inspect the goods immediately upon receipt and immediately note any defects on the consignment note and notify schlumpf innovations gmbh in writing. Defects which cannot be discovered immediately even after careful inspection must be reported to schlumpf innovations gmbh in writing immediately after their discovery. In the event of justified complaints, the Seller undertakes, to the exclusion of any other claims, to rectify the defect (maximum three attempts) and/or to deliver a replacement, at the Seller's discretion. In this case, the corresponding expenses in the form of labour and material shall be borne by schlumpf innovations gmbh. The transport costs to and from the place of performance, on the other hand, shall be borne by the purchaser. In case of unsuccessful repair and/or replacement, the purchaser may demand a reduction of the purchase price or withdraw from the contract.
§ 8 Warranty
Two years manufacturer's warranty is granted for own products of schlumpf innovations gmbh. For commercial products, the warranty information of the respective manufacturer applies.
§ 9 Forfeiture of guarantee and warranty claims
The warranty and guarantee claims of the purchaser against the seller expire if the delivered item has been modified by third parties or by the installation of parts of foreign origin. No guarantee or warranty claims can be made for damage caused by accident, improper use, negligence or lack of maintenance.
